Jobber Privacy Notice to US Residents

This Privacy Notice for residents of the United States supplements the information in our Privacy Policy located at getjobber.com/privacy-policy/ and applies to all visitors, users, and others who reside in states with privacy laws, including California, Colorado, Connecticut, Florida, Indiana, Iowa, Kentucky, Montana, Oregon, Texas, Tennessee, Utah, and Virginia residents whose Personal Information is collected pursuant to the California Consumer Privacy Act (“CCPA”)(as amended by the California Privacy Rights Act), Colorado Privacy Act (“CPA”), Connecticut Data Privacy Act (“CTDPA”), Florida Digital Bill of Rights (“FDBR”), Indiana Consumer Data Protection Act (“ICDPA”), Iowa Data Protection Act (“IDPA”), Kentucky Consumer Data Protection Act (“KCDPA”), Montana Consumer Data Privacy Act (“MCDPA”), Oregon Consumer Privacy Act (“OCPA”), Tennessee Information Protection Act (“TIPA”), Texas Data Privacy and Security Act (TDPSA”), Utah Consumer Privacy Act (“UCPA”), Virginia Consumer Data Protection Act (“VCDPA”), and other states that may adopt laws after the publication of this Privacy Policy (generically referred to as “Privacy Laws”).
States with privacy laws may provide its residents with certain rights, which may include all or some of the following, the right to request access to, obtain, correct, amend, delete, or limit the use of your Personal Data.
With respect to users who are residents of a state with Privacy Laws, this notice is incorporated and made a part of our Privacy Policy, and the terms of this US Privacy Law Notice shall control with respect to residents of the state with the applicable Privacy Laws.
The following explains the rights you may have, depending on where you reside and the jurisdiction that Jobber is subject to related to your Personal Data.
As explained above, some or all of the privacy rights set forth below may apply to you. The following terms in this US Privacy Law Notice supersede any inconsistent terms in any other sections of the Privacy Policy to the extent that any apply to you:

Your Rights Under Privacy Laws
- Right to Access and Know. You may request that we disclose the following information:
- The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
- The specific pieces of Personal Information we collected about you;
- The business or commercial purpose of collecting or sharing Personal Information about you;
- The categories of Personal Information about you that we shared (as defined under the applicable privacy law) and the categories of third parties with whom we shared such Personal Information; and
- The categories of Personal Information about you that we otherwise disclosed, and the categories of third parties to whom we disclosed such Personal Information (if applicable).
Under Privacy Laws, the right to obtain “specific pieces” of Personal Information does not grant a right to the whole of any document that contains Personal Information, but only the right to obtain items of your Personal Information. Additionally, you have a right to know “categories” of sources of Personal Information and “categories” of third parties to which personal information is disclosed, but not the individual sources or third parties. Jobber does not always track individualized sources or recipients.
- Right to be Informed. You may request the manner in which consent can be revoked, and the procedure for lodging grievances and complaints concerning the processing of your Personal Information. In addition, you also have the right to know the following information:
- the purposes of the processing;
- the recipients or categories of recipients to whom the Personal Data have been or will be disclosed, in particular recipients in third countries or international organizations;
- where possible, the envisaged period for which the Personal Data will be stored, or, if not possible, the criteria used to determine that period;
- the existence of the right to request from the data controller rectification or erasure of Personal Data, or restriction of processing of Personal Data concerning you, or to object to such processing;
- the existence of the right to lodge a complaint with the applicable governmental authority;
- where the Personal Data is not collected from you, any available information as to their source; and
- the existence of automated decision-making, including profiling, and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for you.
- Right to Request Correction of your Personal Information. You may request that we correct inaccuracies in your Personal Information. You may also update your Personal Information within your Jobber account on your own;
- Right to Request Deletion of Your Personal Information. You may request to have your Personal Information deleted;
- Right to Opt-out of Sharing for Cross-Context Behavioral Advertising. You may request to opt out of the “sharing” of your Personal Information for purposes of cross-context behavioral advertising.
- Under California law and other state laws, “sharing” personal information for cross-context behavioral advertising is distinct from “selling.” We may share personal information with third parties to deliver targeted advertising (as set forth below) based on your activities across different websites or applications. California residents have the right to opt out of both the sale and the sharing of personal information for cross-context behavioral advertising. You can manage your preferences regarding such targeted advertising (including opting out) by visiting your “Cookies Settings” section, which is located at the bottom of our website. Without limiting the above, we work with third parties to run advertising campaigns. - Right to Data Portability. You have the right to request a copy of your data in a machine-readable format.
- Right to Encryption. Your Personal Information is encrypted at rest/while in storage and/or while in transit.
- Right to Restrict Processing. You may have the right to request the restriction of the processing of your Personal Data where one of the following applies:
- The accuracy of the Personal Information is contested by you, for a period enabling us to verify the accuracy of the Personal Information.
- The processing is unlawful, and you oppose the erasure of the Personal Information and request the restriction of their use instead.
- We no longer need the Personal Information for the purposes of the contemplated processing but it is required by us to exercise or defend legal claims.
- You have objected to processing of your Personal Information pending the verification of whether our legitimate grounds of processing override those of yours.
- Right to Object/Withdraw Consent. You may have the right to object to our reliance on our legitimate interests as the basis of our processing of your Personal Information that impacts your rights.You also may have the right to withdraw your consent to our processing of your Personal Information at any time.
- Right Not to Be Subject to Automated decision making. We do not make decisions based solely on automated processing.
Verification of Requests to Exercise Rights.
When receiving a request, we will verify that the individual making the request is the individual to whom the Personal Information subject to the request pertains. You may exercise your rights yourself or may use an authorized agent to make requests to disclose certain information about the processing of your Personal Information or to delete Personal Information on your behalf. If you use an authorized agent to submit a request, we may request that you provide us additional information demonstrating that the agent is acting on your behalf.
Additional Explanation of Categories of Personal Information We Collect
We collect information that may identify you, your household or your device or is reasonably capable of being connected with or linked to you, your household, or your device. “Personal Information” does not include public information available from government records, de-identified or aggregated information, or information that is protected by other laws.
Additional Disclosure for How We Use Your Information
See our Privacy Policy for how we use your information, which can be viewed at getjobber.com/privacy-policy/. We will not use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
We are not required to (1) retain your Personal Information if collected for a single one-time transaction if, in the ordinary course of business, that information would not be retained and (2) re-identify or otherwise link any data that, in the ordinary course of business, is not maintained in a way that would be considered personal information.
Exemptions to Request to Delete Requests
Unless otherwise required by applicable law, we are not required to grant your deletion request if retaining the Personal Information is necessary for us or our service providers to:
- Complete the transaction for which the Personal Information was collected, fulfill the terms of a written warranty or product recall, or otherwise perform a contract between us and you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
- Debug to identify and repair errors that impact existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act or any other applicable law.
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest when the deletion of the public information is likely to render impossible or seriously impair the achievement of such research, if the consumer has provided informed consent.
- For solely internal uses that are reasonably aligned with your expectations based on your relationship with us.
- Comply with a legal obligation.
- Internally make otherwise lawful uses of your Personal Information that are compatible with the context in which you provided your Personal Information.
Where we have made Personal Information public and are obliged pursuant to applicable law to erase the Personal Information, we shall, taking account of available technology and the cost of implementation, take reasonable steps, including technical measures, to inform other controllers processing the Personal Information that you have requested erasure by such controllers of any links to, or copy or replication of, those Personal Information, as far as processing is not required. We will arrange the necessary measures in individual cases.
We Will Not Discriminate Against You for Exercising Your Rights
We will not discriminate against you, including employees’, applicants’, and independent contractors’ right not to be retaliated against, for exercising any of your rights under the Privacy Laws. We will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods and services or a different level or quality of goods or services.
Exercising Your Right to Erasure
If you have such right, and you wish to request the erasure of Personal Data stored by us, you may, at any time, contact us via email to make such request as provided below.
Where we have made Personal Data public and are obliged to erase the Personal Data, we shall, taking account of available technology and the cost of implementation, take reasonable steps, including technical measures, to inform others processing the Personal Data that you have requested erasure. We will arrange the necessary measures in individual cases.

Unless otherwise provided for under applicable privacy law, only you, or someone legally authorized to act on your behalf, may make a verifiable request to your Personal Information. Unless otherwise provided for in applicable privacy law, we are not required to provide you with Personal Information more than twice in a 12-month period.
We will not be able to respond to your request to provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you or someone you are authorized to request and receive the Personal Information on behalf of.
Unless legally obligated to respond in a shorter timeframe, we will try to respond to your request within forty-five (45) days of receipt of your written request. If we require more time (up to 90 days), we will inform you of the extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.
We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions.
APPEALS: If you are a resident in a state that provides any of the rights set forth in this US Privacy Law Notice and Jobber refuses to take action on your request related to any of the above specified rights or any other privacy related request, you may appeal Jobber’s refusal by clicking the link below, filling out the form and submitting it to us. We will inform you in writing of any action taken or not taken in response to your appeal within sixty (60) days of receiving your appeal. Our response will include a written explanation of the reason or reasons for our decision. If we deny your appeal, you may contact the attorney general in your state to file a complaint.
