Terms and Conditions – Jobber Get Noticed Score

These Terms govern your use of the Get Noticed Score (the “Tool”) available at https://www.getjobber.com/free-tools/grader/get-noticed-grader/terms-of-service/ and provided by Octopusapp Inc. d/b/a Jobber (“Jobber, “we”, “our”). By using the Tool, you agree to these Terms.

1. User Declarations

By using the Tool, you confirm that:

• You are at least 18 years old and legally able to enter into agreements.
• Your use complies with all laws and does not infringe third-party rights.

2. Authorization to Analyze

By submitting a website, you authorize us to:

• Access and analyze it using automated and manual tools, including artificial intelligence (“AI”) and web crawlers;
• Scrape publicly available data and metadata from the site and related sources (e.g., business listings, SEO profiles, and social platforms) to the extent legally permitted;
• Store and process the data to generate a performance report.

3. Purpose of the Tool

The Tool is intended to help users analyze their own websites, domains, or other digital properties to generate performance insights and business-related suggestions. It is not intended for analyzing properties you do not own or control unless you are expressly authorized.

4. Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Tool for its intended purpose, subject to these Terms. We retain all rights not expressly granted.

5. Use of Results

• Reports are for informational purposes only and do not guarantee results.
• The Tool may use AI and heuristics, and we do not guarantee accuracy, completeness, or real-time precision.
• You agree not to rely on the Tool as your sole basis for decisions. We do not warrant the accuracy, completeness, or reliability of the Tool and disclaim liability for any decisions made based on it.

6. Intellectual Property

• We own all rights to the Tool, its software, and the analysis reports.
• You may use reports for personal or internal business use only.

7. Prohibited Uses

You may not:

• Analyze websites you don’t own or have permission to access;
• Reverse-engineer, resell, or misuse the Tool;
• Use the Tool for illegal, harmful, or unauthorized purposes.

8. Data & Privacy

• We may collect and process technical, usage, and performance data from your use of the Tool.
• This data may be used to operate, maintain, improve, and develop the Tool and other products or services, including for internal research, analytics, and AI model training.

9. Disclaimer & Limitation of Liability

The Tool is provided “as is” without warranties of any kind, express or implied, including without limitations, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Jobber is not liable for any indirect, incidental, or consequential damages, including lost profits or data.

10. Indemnification

You agree to indemnify and hold Jobber and its affiliates harmless from any claims arising from your misuse of the Tool or breach of these Terms.

11. Changes & Governing Law

We may update these Terms at any time. Continued use means you accept the changes. These Terms are governed by the laws of the Province of Alberta. Disputes will be resolved exclusively in Edmonton, Alberta.
